Right of Withdrawal
I. Right of Withdrawal
You have the right to withdraw from this contract within fourteen (14) days without giving any reason.
The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods.
To exercise your right of withdrawal, you must inform us (Lotta GmbH & Co KG, Brockmanngasse 7, 8010 Graz, Austria, +43 677 / 64 86 75 50, support@lottacurls.com) of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post or email). You may use the attached model withdrawal form, but this is not mandatory.
To meet the withdrawal deadline, it is sufficient that you send the notification of exercising the right of withdrawal before the withdrawal period expires.
II. Exclusion of the Right of Withdrawal
The right of withdrawal does not apply to distance contracts for the delivery of sealed goods which are not suitable for return due to health protection or hygiene reasons, if their seal has been removed after delivery. This applies in particular to hair products, which cannot be returned after opening or use for hygiene reasons.
Note for orders from Switzerland:
There is no legal right of withdrawal for orders from Switzerland. A withdrawal or return is only possible within the scope of our voluntary goodwill policy and only if expressly agreed in writing.
III. Consequences of Withdrawal
If you withdraw from this contract, we shall reimburse you all payments received from you, including delivery costs (except for any additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and no later than fourteen (14) days from the day on which we received notice of your withdrawal.
We will use the same means of payment you used for the original transaction, unless expressly agreed otherwise; in no case will you be charged fees for this refund.
We may withhold the reimbursement until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.
You must return or hand over the goods to us without undue delay and in any event not later than seven (7) days from the day on which you notify us of the withdrawal from this contract. The deadline is met if you send back the goods before the period of fourteen days has expired.
You bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods if this loss in value is due to handling them in a way not necessary to examine their nature, characteristics and functioning.
IV. Returns and Liability
If you return goods to us, you are responsible for ensuring safe shipping and proper delivery. Please use a shipping service with tracking and keep the shipping receipt. Lotta GmbH & Co KG does not accept liability for lost or damaged returns caused by the shipping carrier.
Please note:
If you received free products as part of a promotion and your return lowers the order total below the promotional threshold, you are required to return the free items as well. Otherwise, their value (based on regular shop prices) will be deducted from your refund.
Shipping cost adjustment:
If your order originally qualified for free shipping and your return reduces the order total below the minimum for free shipping, the original shipping costs will be deducted from your refund.
